GENERAL TERMS AND CONDITIONS OF SALE

Article 1 – Scope of application

These general terms and conditions of sale apply, within the framework of the distance selling service of the company HIBISCUS CBD (hereinafter, "the Seller"), to all sales made through the website hibiscus-cbd.com . HIBISCUS CBD reserves the right to modify these general terms and conditions of sale at any time, provided that such modifications are published on the site.

Article 2 – Products and Product Warranty

The products offered for sale are presented on the website hibiscus-cbd.com and are accompanied by a description. Elements such as photographs, texts, graphics, and all information related to the products are not contractual, which the customer acknowledges.

Legal guarantee of conformity and guarantee against hidden defects

HIBISCUS CBD guarantees the conformity of the product with the contract, allowing the customer to submit a claim under the legal guarantee of conformity provided for in articles L. 217-4 and following of the Consumer Code or the guarantee for defects in the goods sold within the meaning of articles 1641 and following of the Civil Code. In the case of application of the legal guarantee of conformity, please note that:

• The customer has a period of 2 years from the delivery of the product to take action.

• The customer can choose between repairing or replacing the product, subject to the cost conditions stipulated by law.

• The customer is not required to provide proof of non-conformity during the 6 months (second-hand products) or 24 months (new products) following the delivery of the product.

Commercial guarantee

The products sold are also covered by a commercial guarantee that ensures their conformity and the reimbursement of the purchase price, the replacement or repair of the goods.

Article 3 – Price

Our product prices are shown in Euros, including all taxes, excluding processing and shipping costs. All orders will be paid in Euros.

HIBISCUS CBD reserves the right to modify its prices at any time, but products will be invoiced based on the prices in effect at the time of ordering, subject to availability.

Article 4 – Client Obligations

The Customer declares that they are at least 18 years old and have legal capacity or have parental authorization to place an order on the site.

The Customer agrees to provide HIBISCUS CBD with the correct and necessary information to process the order, such as name, address, phone number, and email address. The Customer is responsible for the consequences arising from the transmission of false or incorrect information.

Article 5 – Order

The customer can place the order through the website hibiscus-cbd.com . The order will be shipped once payment is received.

Article 6 – Validation

By clicking on the "Confirm Order" button, the Customer accepts the General Terms and Conditions of Sale in full and without reservation.

Article 7 – Method of Payment

Payment will be made upon completion of the order, using one of the payment methods available on the site:

• Cash on Delivery

HIBISCUS CBD reserves the right to suspend order processing in case of payment refusal by the bank or in case of non-payment.

Article 8 – Availability

Product offers are valid while they are visible on the site, until stocks last. In case of product unavailability, the customer will be notified and offered the option to change or cancel the order.

Article 9 – Delivery

Products will be delivered to the address indicated by the customer during the ordering process. It is important to verify that the delivery information is correct.

Article 10 – Shipping Costs

Shipping costs are added to the product price and will be calculated at the end of the purchase process.

Article 11 – Retention of Ownership

The products remain the property of HIBISCUS CBD until the full price has been paid.

Article 12 – Right of withdrawal

The Customer has the right to cancel the purchase within 14 days of receiving the products, without needing to provide a reason. The product must be returned in its original packaging and undamaged.

Article 13 – Liability

HIBISCUS CBD will not be held responsible in case of force majeure, disruptions or problems related to transport or postal services.

Article 14 – Applicable Law and Jurisdiction

This contract is governed by Spanish law. Any dispute related to the contract will be resolved in the competent courts of Spain.
